EXPORT COMPLIANCE STATEMENT

Dear Valued Customer,
The commodities purchased from Aerotechnic Pty Ltd (South Africa-SH383) ("Seller") and the supporting technical data are subject to the national or to the United States Government’s Export Administration Regulations (“EAR”) or the International Traffic in Arms Regulations (“ITAR”).
Please complete and return this Export Compliance Statement and Seller will retain this document for future orders.

Customer warrants that it will not sell, resell, license, transfer, export or re-export any commodity purchased from Seller in any manner, to any person, to any country, or for any use prohibited by the national laws or regulations or those of the United States (U.S.), including but not limited to the Arms Export Control Act, Export Administration Act, Foreign Corrupt Practices Act, Anti-Boycott Law, and their implementing regulations, unless otherwise authorised by national or by the U.S. Government.

Customer also warrants that the commodities purchased will not be used for any purpose connected with chemical, biological, or nuclear weapons, or missiles capable of delivering such weapons, nor will they be resold if it is known or suspected that the commodities are intended or likely to be used for such purpose.

Customer acknowledges that U.S. law prohibits the sale, transfer, export or re-export or other participation in any export transaction involving U.S. products, technology or software with individuals or companies listed in the U.S. Department of Commerce’s Table of Denial Orders, Entity List, Unverified List or any current General Order issued by the Department of Commerce, the U.S. Department of the Treasury’s list of Specifically Designated Nationals, or the U.S. Department of State’s Debarred List or Non-proliferation Sanctions listing.

Customer will abide by all applicable U.S. export control laws and regulations for any products, technology or software purchased from the Seller, and will obtain any licenses or prior approvals required by the U.S. Government prior to export or re-export of U.S. supplied products, technology or software.

Customer agrees that the export control requirements set out above shall survive the completion, termination, cancellation or expiration of the applicable purchase order, agreement or contract. This certification applies to the Customer including all subsidiaries and affiliated companies.

Customer hereby indemnifies the Seller and shall hold the Seller harmless from and against any and all damages; claims; losses; civil penalties; criminal penalties; and other costs, including attorney fees, arising from or in connection with any violation by Customer of the aforesaid laws and regulations.
